How Rescato works during the Málaga pilot: what a reservation is, how you pay at the shop and who to complain to.

  1. 1. What Rescato is

    Rescato is an online service that puts people in Málaga in touch with shops that have surplus food.

    Rescato does not buy, store, sell or handle food, and it does not receive your money.

    Each pack is surplus from the shop that offers it.

    For now the service only operates in Málaga.

    Rescato is in a limited pilot: it earns no revenue, and no pickup has yet been completed with a real consumer.

  2. 2. Your account

    You must be 18 or over to have a Rescato account.

    Rescato uses push notifications to tell you about your reservations.

  3. 3. How a reservation works

    Reserving a pack means the shop sets it aside for you. The sale happens at the shop, with the shop, in cash.

    Until you collect the pack there is no contract of sale and no obligation to pay.

    A reservation lasts until 22:00, the shop’s local time: if you reserve before 22:00, until 22:00 that same day; if you reserve at or after 22:00, until 22:00 the next day.

    If you do not collect the pack in time, the reservation lapses and the pack may be offered to someone else.

    If you change your mind, simply don’t go: there is no charge and no penalty.

    The shop may only refuse to hand the pack over to you for one of these reasons:

    • the pack is no longer fit to be sold;
    • the reservation has lapsed;
    • you cannot show the pickup code;
    • the pack contains an age-restricted product and you cannot show that you are of age.
  4. 4. Price and payment

    The price shown in the app is the price you pay at the shop, VAT included.

    You pay in cash, directly to the shop, when you collect the pack. Rescato charges no fee and receives no payment.

    The shop gives you the receipt for the sale. Rescato issues no tickets or invoices; what the app shows at pickup is for information only.

    If the till charges a different price, you can walk away without paying. If that happens, write to hola@rescato.es: Rescato will take it up with the shop.

    Any refund or complaint about the food or the price is between you and the shop, and the shop’s receipt is the document for it. If you ask, Rescato will pass your complaint on to the shop.

  5. 5. The food

    The shop decides what it offers and is responsible for it. Rescato’s review is an additional filter, not a guarantee.

    Food past its use-by date is never offered.

    The date you see is the earliest among the products in the pack, as the shop entered it.

    A pack may contain age-restricted products such as alcohol. The shop checks your age at the counter, as the law requires, and may refuse to sell them to you.

    Put anything that needs it in the fridge as soon as you get home, follow the storage instructions on the label and use your own judgement: if something looks or smells wrong, do not eat it.

  6. 6. Automatically generated information

    Recipes, dish images and the ingredient, allergen and dietary notes are produced with the help of an automated system from the information the shop provides. The images are presentation suggestions, not photographs of the pack. What counts is the product label and what the shop tells you. If you have an allergy, ask before buying.

  7. 7. What Rescato does for you

    If you need the details of the shop that sold you a pack (name, address and NIF), ask at hola@rescato.es and Rescato will give them to you.

    Nothing in these terms limits the rights the law gives you as a consumer.

  8. 8. Complaints

    Rescato answers complaints within 15 days of receiving them.

    Complaint forms (hojas de quejas y reclamaciones) are available in paper and electronic form; complaints filed that way are answered within 10 working days (10 días hábiles).

    If your complaint is not resolved, Rescato will tell you the competent public consumer body and whether it will take part.

  9. 9. Content and moderation

    As a consumer you publish nothing that other people can see: Rescato has no ratings, reviews or comments.

    Pack information comes from the shop. Before it is published, every pack goes through an automated review and a manual review, and Rescato may decide not to publish it.

  11. 11. Changes to these terms

    This is version 1.0 of these terms.

    For an important change, Rescato will tell you in the app and by email at least 15 days before it applies. If you keep using Rescato after that date, you accept the new version.

  12. 12. Governing law and courts

    These terms are governed by Spanish law. If you have a dispute with Rescato, you can go to the courts where you live.
